Governing Jurisdiction: Sweden | Applicable Law: EU Digital Services Act, Swedish Lag (2022:000) om digitala tjänster, GDPR, and applicable EU consumer protection law.
1. Introduction and Acceptance
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and NewsWave, a sole trader business (Swedish enskild firma) operated by Sadashiv Gour and established in Sweden ("NewsWave", "we", "us", "our"), governing your access to and use of the NewsWave mobile application, web application, and related services (collectively, the "Service").
By accessing, downloading, installing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease use of the Service.
These Terms are supplemented by our Privacy Policy, Cookie Policy, and Content Usage & Copyright Policy, each of which is incorporated by reference herein.
2. Eligibility and User Requirements
2.1 Age Requirements
The Service is intended for users who are at least 16 years of age. If you are between 16 and 18 years old, you represent that your parent or legal guardian has reviewed and consented to these Terms on your behalf.
We do not knowingly provide the Service to children under the age of 16. If we become aware that a user is under 16, we will take steps to terminate that user's account and delete any associated personal data, in compliance with Article 8 of the GDPR and applicable Member State law.
2.2 Jurisdictional Eligibility
The Service is primarily designed for users residing within the European Economic Area (EEA). You may access the Service from other jurisdictions, but you do so at your own risk and you are solely responsible for compliance with local laws and regulations. We make no representation that the Service is appropriate or lawful for use in any jurisdiction outside the EEA.
2.3 Account Registration
Where account registration is required:
- You must provide accurate, current, and complete information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must notify us immediately at legal@thenewswave.app upon any unauthorized use of your account.
- You may not create accounts using automated means, false identity, or on behalf of another person without authorization.
3. Description of the Service
3.1 Scope of Service
NewsWave provides a news aggregation and personalization platform that:
- Aggregates publicly available news content from RSS feeds, openly licensed sources, and select online publications;
- Extracts and displays article summaries, metadata, titles, and hyperlinks;
- Personalizes content delivery based on user-provided demographic information, stated interests, and behavioral interactions within the Service;
- Offers bookmarking, search, and content-categorization features;
- Provides push notifications for news updates where the user has consented.
3.2 Nature of Content
The Service is an aggregation platform only. We do not generate, author, or editorially curate the news content displayed. All articles, reports, and media remain the property of their respective original publishers and authors. NewsWave acts as an intermediary that facilitates access to third-party content.
3.3 Limitations and Exclusions
The Service does not:
- Guarantee the accuracy, completeness, timeliness, or editorial balance of any aggregated content;
- Endorse any political viewpoint, publication, or editorial stance;
- Provide legal, financial, medical, or professional advice through aggregated content;
- Guarantee uninterrupted, error-free, or continuous availability of the Service.
4. Acceptable Use Policy
4.1 Permitted Use
You may use the Service solely for personal, non-commercial news consumption and information access, subject to these Terms.
4.2 Prohibited Conduct
You agree not to:
- Scrape, crawl, or harvest content, user data, or any other information from the Service using automated means, bots, spiders, or data mining tools without our express written consent;
- Reproduce, redistribute, or republish any aggregated content beyond what is permitted under applicable copyright law and these Terms;
- Circumvent, disable, or interfere with security features, access controls, or technical protection measures of the Service;
- Transmit or upload any malware, viruses, trojan horses, or other harmful or malicious code;
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity;
- Use the Service for any unlawful purpose or in violation of any applicable law, including EU and Swedish law;
- Reverse-engineer, decompile, or disassemble any portion of the Service;
- Commercially exploit the Service, including reselling access to it, without prior written authorization;
- Attempt to gain unauthorized access to any portion of the Service, or any systems or networks connected thereto;
- Harass, intimidate, or harm other users, or interfere with the use and enjoyment of the Service by others.
4.3 Consequences of Violation
Breach of this Acceptable Use Policy may result in immediate suspension or permanent termination of your access to the Service, at our sole discretion, and may also expose you to civil or criminal liability.
5. Intellectual Property Rights
5.1 NewsWave Proprietary Rights
The Service, including but not limited to its software, mobile and web application code, user interface, design, logos, trademarks, service marks, trade dress, algorithms, and any original text or structured data created by NewsWave (collectively, "NewsWave IP") is and remains the exclusive property of Sadashiv Gour (operating as NewsWave) and/or its licensors.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes.
You are expressly prohibited from reproducing, modifying, distributing, publicly displaying, creating derivative works from, or otherwise exploiting any NewsWave IP without prior written consent.
5.2 Third-Party Content
All news articles, images, video, audio, and other content sourced from third-party publishers, RSS feeds, and open sources (collectively, "Third-Party Content") are the intellectual property of their respective owners and are protected by applicable copyright and related rights law, including Directive 2019/790/EU on Copyright in the Digital Single Market (DSM Directive).
NewsWave:
- Does not claim ownership of Third-Party Content;
- Displays Third-Party Content under one or more of the following: (i) explicit licensing arrangements with publishers, (ii) RSS feed terms that permit aggregation and display, (iii) the right of quotation and hyperlinking under Articles 15 and 17 of the DSM Directive, or (iv) other applicable exceptions under EU copyright law;
- Provides, where possible, only excerpts, headlines, and metadata accompanied by a hyperlink directing users to the original source;
- Will respond promptly to valid copyright infringement notices submitted under Section 13 (Notice and Takedown).
5.3 User-Generated Content
If the Service permits users to submit content (e.g., comments, feedback, or annotations), you grant NewsWave a worldwide, royalty-free, non-exclusive licence to use, reproduce, modify, and display such content solely for the purpose of operating and improving the Service. You represent and warrant that you own or have the right to submit such content and that it does not infringe any third-party rights.
5.4 Trademarks
"NewsWave" and associated logos and marks are registered or unregistered trademarks of Sadashiv Gour (operating as NewsWave). Nothing in these Terms grants you any right to use our trademarks without prior written permission.
6. Disclaimer of Liability
6.1 Content Accuracy
The Service aggregates content from a wide range of third-party sources. We make no warranties or representations, express or implied, as to the accuracy, completeness, reliability, currency, or fitness for a particular purpose of any aggregated content. You rely on any aggregated content at your own risk.
6.2 Third-Party Sources
We are not responsible for the content, practices, or policies of third-party websites or publishers to which the Service links. The inclusion of a link does not constitute an endorsement of the linked site.
6.3 Limitation of Liability
To the maximum extent permitted by applicable EU and Swedish law:
- The Service is provided "as is" and "as available" without warranties of any kind, either express or implied;
- NewsWave shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption, arising out of or in connection with your use of the Service;
- Our total aggregate liability to you in connection with the Service shall not exceed EUR 100 in any twelve-month period.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability that cannot lawfully be excluded under Swedish or EU law, including mandatory consumer protection rights under Directive 2011/83/EU.
6.4 Service Availability
We do not warrant that the Service will be available at all times or free from errors, interruptions, or defects. We reserve the right to suspend the Service for maintenance, updates, or other operational reasons without prior notice, though we will endeavour to provide notice where practicable.
7. Service Modifications and Updates
We reserve the right to:
- Modify, suspend, or discontinue any part of the Service at any time;
- Update these Terms at any time.
Where changes are material, we will notify you by in-app notification, push notification (where enabled), or email, at least 30 days in advance. Continued use of the Service after the effective date of revised Terms constitutes acceptance. If you do not accept the revised Terms, you must cease using the Service and may delete your account.
Minor modifications (e.g., typographical corrections, clarifications that do not affect your rights) may be made without prior notice.
8. Account Suspension and Termination
8.1 Termination by User
You may terminate your use of the Service at any time by deleting your account through the in-app settings or by contacting us at support@thenewswave.app. Upon account deletion, we will process your personal data in accordance with our Privacy Policy.
8.2 Termination by NewsWave
We may suspend or terminate your access to the Service, with or without prior notice, if:
- You breach any provision of these Terms;
- You engage in fraudulent, unlawful, or abusive behavior;
- We are required to do so by law or competent authority;
- We discontinue the Service.
8.3 Effect of Termination
Upon termination, your licence to use the Service ceases immediately. Sections 5, 6, 9, 10, and 11 of these Terms survive termination.
9. Governing Law
These Terms, and any dispute arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of Sweden, without regard to conflict of law principles.
As a consumer residing in an EU Member State, you also benefit from mandatory protections under the law of your country of habitual residence that cannot be derogated from by contract. Nothing in these Terms shall be construed to deprive you of such protection.
10. Dispute Resolution
10.1 Informal Resolution
We encourage you to contact us first at legal@thenewswave.app to resolve any dispute informally. We will make reasonable efforts to address your concern within 30 days.
10.2 Alternative Dispute Resolution (ADR)
In the event that a dispute cannot be resolved informally, and you are a consumer, you have the right to access an Alternative Dispute Resolution (ADR) body. In Sweden, this is:

10.3 Jurisdiction
Subject to mandatory consumer law rights, any legal proceedings shall be brought in the courts of Sweden. Consumers may also bring proceedings in the courts of their country of habitual residence within the EU.
11. General Provisions
11.1 Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy, and Content Usage & Copyright Policy, constitute the entire agreement between you and NewsWave regarding the Service and supersede all prior agreements, understandings, or representations.
11.2 Severability
If any provision of these Terms is found to be invalid or unenforceable by a competent court, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
11.3 Waiver
Failure by NewsWave to enforce any provision of these Terms shall not constitute a waiver of the right to enforce such provision in the future.
11.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may freely assign our rights to a successor entity in connection with a merger, acquisition, or sale of assets.
11.5 Force Majeure
NewsWave shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, or governmental action.

13. Notice and Takedown Procedure
If you believe that content displayed through the Service infringes your intellectual property rights or violates applicable law, please submit a written notice to:

Your notice must include:
- Your full name, address, telephone number, and email address;
- A description of the copyrighted work or other protected right that you claim has been infringed;
- A description of the content you claim is infringing, with sufficient detail for us to locate it;
- A statement that you have a good faith belief that the use is not authorized by the rights holder, its agent, or the law;
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf;
- Your electronic or physical signature.
We will process valid notices within 10 business days and take appropriate action in accordance with the DSA and applicable copyright law.
These Terms and Conditions were last reviewed by qualified EU legal counsel and are intended to be consistent with applicable EU and Swedish law as of the effective date stated above.
